Welcome to Embedn Inc. By accessing or using our app and services (collectively, the “Services”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, you may not use our Services.

1. Acceptance of Terms

To access or use our Services, you must accept these Terms unconditionally. You can accept these Terms by clicking the acceptance option or by using the Services. You must be of legal age and capacity to form a binding contract to accept these Terms.

2. Privacy Policy
Your personal information will be handled in accordance with our Privacy Policy, which is incorporated by reference into these Terms. By using our Services, you consent to our Privacy Policy, which you can review at any time within the app.

3. The App

Embedn Instasavings is a mobile app that allows users (“Users”) to access digital coupons (“Coupons”) offered by third parties. Users can create a free User Account, as described in Section 4, to store and manage Coupons in a digital wallet (“Wallet”). While we facilitate the Wallet, we do not guarantee the validity, availability, or accuracy of any Coupons and are not liable for any loss or damage associated with Coupons.

4. Registration

To use certain features of the Services, you may need to create a User Account. You agree to provide accurate, current, and complete information during registration and to update it as necessary. You are responsible for safeguarding your account credentials and must notify us immediately of any unauthorized use. You are responsible for all activity under your User Account.

Embedn reserves the right to suspend or terminate your User Account at any time for any reason. You may delete your User Account at any time by contacting support@embedn.com. Termination may result in the loss of access to Coupons associated with your account, and Embedn is not liable for any such loss.

5. Fees

Our Services are free to use. The Coupons stored in your Wallet are offered by third parties, and Embedn does not facilitate purchases or payments through these Coupons. We are not responsible for any fees associated with the use of Coupons.

6. Not a Payment Processor

Embedn is not a payment processor. All payments related to your use of the Services are processed through a secure third-party payment gateway. We do not store your payment information. We are not liable for any issues arising from your use of any third-party payment services.

7. Content and Ownership

All content in the Embedn Instasavings app, including text, graphics, logos, and other materials (“Content”), is owned or licensed by Embedn and is protected by copyright and trademark laws. You may not use any Content without our prior written consent.

8. Your Use of the Services

You are granted a revocable, nontransferable, nonexclusive license to access and use the Services solely for personal use. You may not use the Services for any commercial purpose or engage in any illegal activities.

You agree not to:
● Violate any applicable laws or regulations.
● Infringe on the rights of others, including intellectual property rights.
● Use the Services in a harmful, deceptive, or abusive manner.
● Attempt to gain unauthorized access to the Services or any user accounts.
● Use any automated means to access the Services without our prior written permission.

9. User Reports

Embedn may aggregate and deidentify personal information to create reports (“Reports”). These Reports will be owned by Embedn and can be used for internal purposes.

10. Feedback

You may provide feedback regarding the Services (“Feedback”). By providing Feedback, you grant Embedn a royalty-free, worldwide, transferable, sub-licensable, irrevocable license to use and incorporate such Feedback.

11. Security

You agree not to violate or attempt to violate the security of the Services.

Prohibited actions include, but are not limited to:

● Accessing data not intended for you.

● Attempting to probe, scan, or test the vulnerability of the Services.

● Interfering with the service to any user.

12. Disclaimers and Limitation of Liability

Embedn makes no warranties regarding the Services and is not liable for any indirect, incidental, or consequential damages. Our liability is limited to the maximum extent permitted by law.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Insert Governing Law], without regard to its conflict of law provisions.

14. Changes to Terms

Embedn reserves the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms in the app. Your continued use of the Services after such changes will constitute your acceptance of the new Terms.
